Eaton Fire Lawsuit Overview

The Eaton Fire ignited on January 7, 2025, in the foothills above Altadena and Pasadena and grew within hours into one of the most destructive wildfires in Los Angeles County history. Driven by hurricane-force Santa Ana winds, the fire swept through neighborhoods in Altadena, Sierra Madre, Pasadena, and unincorporated portions of the San Gabriel foothills, destroying more than 9,000 structures, killing residents who could not escape in time, and displacing tens of thousands of families.

Cause of the Fire

Multiple eyewitness accounts, photographs, and video evidence point to electrical infrastructure operated by Southern California Edison (SCE) as the ignition source. Investigators have focused on transmission lines, distribution equipment, and energized conductors in Eaton Canyon that allegedly arced or failed during the high-wind event. SCE has reported electrical anomalies on its system at the time of ignition, and the California Public Utilities Commission (CPUC) and CAL FIRE are conducting formal investigations.

Who Can Sue Southern California Edison

California's doctrine of inverse condemnation allows property owners to recover from a public utility whose equipment causes a fire — without requiring proof of negligence — when the utility's infrastructure is a substantial cause of the loss. In addition, victims may pursue traditional negligence, premises liability, trespass, and nuisance claims, as well as claims for emotional distress and personal injury.

Who May File a Claim

Eligible claimants include homeowners, renters, business owners, employees who lost wages, agricultural operators, and family members of those killed or injured. Renters can recover for the loss of personal property, additional living expenses, displacement, and emotional distress. Business owners may recover for property damage, business interruption, lost profits, and loss of goodwill.

Damages You May Recover

Compensation in the Eaton Fire litigation may include the full cost to repair or rebuild your home, replacement value of personal property and irreplaceable items, additional living expenses incurred during displacement, loss of use, diminution in property value, smoke and ash remediation, debris removal, lost wages and lost business income, emotional distress and pain and suffering, wrongful death damages for surviving family members, and — where utility misconduct is proven — punitive damages.

Insurance, Underinsurance, and Uninsured Losses

Many Eaton Fire victims discovered after the fire that their insurance policies were inadequate or that California FAIR Plan coverage left them severely underinsured. Lawsuits against SCE proceed independently of, and in addition to, insurance recoveries. We coordinate every fire claim alongside our insurance bad-faith and FAIR Plan litigation practices to maximize total recovery.

Why Choose Keosian Law

Our attorneys have decades of combined experience in California wildfire litigation, utility liability, and insurance bad faith. We know how to build inverse-condemnation cases against SCE, document every category of loss, and pursue both prompt mass-claim resolutions and individualized damages trials when warranted. No attorney fees or costs unless we recover for you.
